These Terms of Service (“Terms”) govern your access to and use of By Flip’s Design (“BFD,” “we,” “us”), including byflipsdesign.com and our related websites, apps, and services (together, the “Services”). Please read them carefully. If you use the Services on behalf of an organization, you agree to these Terms on its behalf.
By creating an account or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services, and certain features are restricted to users 21 and older. You are responsible for the accuracy of your registration information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
You agree not to misuse the Services — including by breaking the law, infringing others’ rights, uploading harmful or misleading content, harassing other users, attempting to disrupt or gain unauthorized access to our systems, or scraping data without permission. We may remove content or suspend accounts that violate these Terms.
Where the Services let you buy tickets, memberships, or other paid items, you authorize us and our payment processors to charge your selected payment method for the amounts shown, including applicable taxes and fees. Unless stated otherwise or required by law, purchases are non-refundable. Prices and availability may change.
You retain ownership of the content you submit, and you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it as needed to operate and improve the Services. The Services themselves — including our software, branding, and design — are owned by BFD or our licensors and are protected by intellectual-property laws. You may not copy or reuse them except as permitted.
The Services may link to or integrate with third-party products (for example, payment processors, wearable-device providers, and mapping services). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
The Services are provided “as is” and “as available,” without warranties of any kind. Fitness, nutrition, and health information in the Services is for general informational purposes only and is not medical advice; consult a qualified professional before acting on it.
To the fullest extent permitted by law, BFD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
You may stop using the Services at any time and request account deletion from your settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will do so.
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.
